Equipment Rental Agreement – Terms and Conditions – Rent And Pull, LLC

By accepting these terms and conditions you are digitally signing this contract and you agree to abide by it and can be held liable should there be an issue with the rental.

Effective Date: December 1, 2025

1. DEFINITIONS

Agreement – This contract, including all terms and conditions herein and any related documents provided at the time of rental.

Renter / You – The individual or entity renting the trailer, including all authorized drivers and any person or organization to whom charges are billed. All are jointly and severally bound.

Company / We / Us – Rent and Pull, LLC, the business renting the trailer.

Authorized Driver – You and any additional drivers listed on this Agreement.

Trailer – The rented non-motorized trailer identified in this Agreement, including any substituted trailer.

Loss of Use – Daily rental rate multiplied by the number of days the trailer is unavailable due to damage, loss, or repair.

Diminished Value – Reduction in fair market value of the trailer and added equipment following damage, whether or not repaired.

2. RENTAL, INDEMNITY, AND WARRANTIES

This is a RENTAL contract only; no ownership rights transfer.

We may repossess the trailer, at your expense and without notice, if it is abandoned, used illegally, or used in violation of this Agreement. The transport of stollen goods while using Rent and Pull LLC equipment is strictly prohibited. Should the trailer get impounded for any reason while in the renter’s possession, the renter will be responsible for all impound and storage fees including days of loss of usage.

You agree to indemnify, defend, and hold us harmless from all claims, liabilities, costs, and attorney fees arising out of your rental or use of the trailer.

We provide no warranties, express or implied, including merchantability or fitness for a particular purpose. Our equipment is checked and serviced regularly.

3. CONDITION AND RETURN OF TRAILER

The trailer must be returned to the designated location on the specified date/time, in the same condition as received (ordinary wear excepted).

If returned after hours, you remain responsible for the trailer until inspected during business hours.

Repairs, service, or parts replacement require our prior written approval.

All provided equipment (straps, tie-downs, tools, etc.) must be returned in the same condition.

4. RESPONSIBILITY FOR DAMAGE OR LOSS

You are responsible for all damage, theft, or loss, regardless of cause, including weather, road conditions, or acts of nature.

You must reimburse us for:

- Repair or replacement costs, or fair market value if not repairable.

- Loss of Use and Diminished Value.

- Missing equipment and administrative costs.

- All accidents or losses must be reported to us and local police within 24 hours.

- Proof of Insurance is required, unless the Renter adds the insurance addendum (Under $15 per trailer / per day). Check the FAQ section of the site for details.

- The lessor is not liable even if the lessee lacks this insurance.

Should the Renter not opt to add the Addendum, the personal insurance policy must include these coverages:

    • At least $250,000 per person, up to $500,000 per incident for bodily injury;
    • And $100,000 for property damage;
    • Or at least $750,000 combined for bodily injury and property damage.

The additional insurance addendum will remove all liabilities from your personal insurance policy and we encourage you to leverage that at $13 per day per trailer rented.

5. PROHIBITED USES

The trailer may not be used for:

- Transporting hazardous, illegal or stolen materials.

- Transporting people.

- Operation by anyone under the influence of drugs or alcohol.

- Operation by anyone not listed as an Authorized Driver.

- Use obtained by fraud, misrepresentation, or illegal purpose.

- Operation outside of the state of Florida unless previously agreed upon in writing.

- Loading beyond manufacturer’s rated capacity. Capacities are listed on the product description page.

- Towing without sufficient clearance or in a way likely to damage the trailer. Drop / raise hitches available if required.

- Improperly securing cargo.

- Intentional, reckless, or negligent conduct.

- Submerging non-marine trailers in water. Replacement cost may apply otherwise.

- Modifying, painting, or applying signage to the trailer.

- Renter must not touch, disable or unhook any tracking devices. If these devices are tampered with, there will be a $500 charge.

6. CHARGES

You agree to pay:

- Rental time and mileage (if applicable). You can return the trailer / equipment by 10am the day after the rental period for no additional cost.

- Taxes, tolls, and all traffic/parking fines, plus a $100 admin fee per unpaid charge.

- Recovery costs if not returned as agreed.

- Collection costs, including attorney fees.

- 5% late fee on overdue balances.

- $50 (or max permitted by law) for returned/unpaid checks.

- Up to $100 cleaning fee if returned excessively dirty.

- No refund for early return unless approved in writing.

- Late trailer returns (Past reservation date/time) will be charged at a daily rate if not returned by 10AM.  Reservation will be adjusted to reflect new end dates and include any weekend rates.

- Incidentals / damage to trailers will be charged to the credit card that was used for the rental reservation. We will communicate with the renter if there will be a charge to the credit card beforehand.

7. DEPOSIT

- We do not currently charge a deposit. Should there be any damage to the trailer rented and accompanying equipment, we will contact the renter and we will charge the amount due to the credit card on file.

- By renting from Rent and Pull, you agree to be charged for any incidental damage automatically by Rent and Pull and the credit card on file will be used. We will always reach out to the renter and discuss the amounts that will be charged before we do so.

8. CANCELLATION POLICY

Cancellation of Reservation:
All reservations are considered confirmed once this Agreement has been executed and payment has been received. The Renter may cancel the reservation only by providing written notice at least one (1) calendar day prior to the scheduled reservation. Cancellation requests are not effective until acknowledged in writing by Rent and Pull, LLC.

Cancellation is not possible if requested less than 24 hours prior to scheduled reservation.

Rescheduling:
At the sole discretion of Rent and Pull, LLC, a reservation may be rescheduled if written notice is received at least one (1) calendar day prior to the scheduled pickup date and equipment availability permits. Rescheduling is not guaranteed.

Weather and Unforeseen Events:
Cancellations due to weather conditions, emergencies, or other unforeseen events shall be handled on a case-by-case basis. Rent and Pull, LLC reserves the right to offer rescheduling in lieu of a refund and is under no obligation to issue refunds outside the terms of this Cancellation Policy.

Acknowledgment:
By signing this Agreement, the Renter acknowledges and agrees that this Cancellation Policy is reasonable, necessary for business operations, and fully enforceable.

9. MODIFICATIONS

No term may be waived or modified except by a written amendment signed by us. This Agreement supersedes all prior representations or agreements.

10. WAIVER AND SEVERABILITY

Failure to enforce any term is not a waiver of our rights.

If any provision is held unenforceable, the remainder of this Agreement remains valid.

We are not liable for consequential, special, or punitive damages.

11. RENTER RESPONSIBILITIES

- Minimum age: 25 years for all drivers.

- Make sure you secure all ramps and make sure you lock them back up using the provided locks.

- All keys are in the lockbox located at the front of the trailer, with a RED cover. Code will be given after reservation is confirmed.

- Ensure all safety chains are properly connected and crossed.

- Always keep the lock on the coupler. Theft is your responsibility.

- Maintain trailers level to prevent damage (drop/rise hitch may be required and are available).

- Cover loads in dump trailers and secure gates before dumping.

- Secure all cargo properly.

- Do not use utility trailers to transport vehicles larger than ATVs, SxS, mowers, or small tractors. The drop gates are not built to hold very heavy vehicles and could bend.

- Ensure towing vehicle capacity meets/exceeds trailer GVWR. GVWR is posted in the product description for each trailer.

- In case of flat tires, contact Rent and Pull, LLC immediately. Use spare/tools provided in the toolbox and return all items.

- If equipped with a winch, neatly rewind cable/rope after use.

By using our service, you acknowledge that you have read, understood, and agree to all terms and conditions of this Agreement.
